Knocked Down Shopper Settles Case

Judge Patrick Leston of DuPage County, approved a $425,000.00 settlement for Rose Erdmann, 89, of Westmont, offered by SVT, LLC.

On August 25, 2011, Rose went to buy chickens at the Ultra Grocery Store at 1212 West 75th Street, Downers Grove.  After she got her cart and started into the store, two cart associates loaded more carts into the row closest to her.  The row of carts knocked down Rose breaking her left hip.  She needed surgery to fix the break.  She made a good recovery.

“Safety of customers must be a primary concern of every employee at the store from manager to cart associate,” said Francis Patrick Murphy, a partner at Corboy & Demetrio.  “All stores have safety procedures how to carefully load carts in the storage area.  But if the managers fail to properly instruct or supervise employees, someone can get seriously hurt,” Murphy concluded.

Trial was set to start March 4, 2013.
