Corboy & Demetrio obtains $4.95 Million in Death of 83-year-old Patient in Medical Malpractice Case
Corboy & Demetrio has obtained a $4.95 million settlement for the estate of an 83-year-old man who fell onto the concrete outside his residence and struck his head. He was taken to a Chicago area hospital. Imaging revealed a nickel-sized subdural hematoma.
The treatment plan was conservative observation unless the subdural hematoma grew, in which case surgery may be indicated. The subdural hematoma did grow in subsequent imaging, according to the medical record. Subsequent to that finding, the man got out of bed and fell to the ground again striking his head.
Despite advanced age and multiple comorbidities, a craniotomy was indicated, which the man underwent. However, he never regained consciousness and died a few days later. The defendant contested liability and causation, arguing that the man fell and died due to the expansion of the subdural hematoma that preceded the fall. The man was undergoing radiation therapy for recurring prostate cancer at the time of his death.
