IL Supreme Court upholds $42.4 Million Medical Malpractice Verdict

The Illinois Supreme Court has denied the defendant's petition for certification of an appeal in Corboy & Demetrio's $42.4 million jury verdict, which, with added prejudgment interest, amounts to $50 million for the firm’s client, the representative of the estate of a 47-year-old Illinois man. The denial was issued on May 29, 2024.

In 2022, Thomas Demetrio and Mike Ditore obtained a record-setting jury verdict of $42.4 million against Advocate Condell Medical Center for the patient’s wrongful death.

The decedent was a quadriplegic who was monitored for the signs and symptoms of baclofen withdrawal while awaiting surgery for the replacement of a pump that delivered the medication to him to control his muscle spasms. 

The 2022 verdict set a record for the highest jury verdict for the wrongful death of a man age 20 or older in a medical malpractice case in Illinois. 

The state’s highest court, in denying defendant’s petition to appeal, let stand the original verdict and the 2024 opinion by the Illinois First District Appellate Court, which found there was enough evidence for a jury to find the hospital liable under the legal theory of institutional negligence due to, in part, a series of miscommunications by the hospital’s doctors, nurses and other staff.
