Corboy & Demetrio Obtains $10 Million Settlement for Missed Cancer Diagnosis

Corboy & Demetrio has obtained a settlement of $10 million against a Chicago-area health system that failed to timely diagnose cervical cancer.

Plaintiff, 38 years old, received gynecological care from a Chicago area health system and several of its doctors for most of her adult life. In February of 2014, she had a visit with her primary care physician.  During that visit, Plaintiff received routine HPV testing which revealed the presence of a high-risk strain of HPV (HPV-16).  The presence of HPV-16 creates a high risk for development of cervical cancer, but Plaintiff was never informed of that.

The standard of care mandated that Plaintiff receive a colposcopy and repeat HPV testing within a year of that positive result.  Despite seeing several of the health system’s doctors in the following years, she did not receive a colposcopy nor repeat HPV testing. 

In 2018, Plaintiff was diagnosed with Stage IIIb cervical cancer for which she was treated with radiation and chemotherapy.  As of the time of settlement approximately five years later, Plaintiff is in remission.
