$11.5 Million Settlement for Failure to Deliver Infant in Timely Manner
Parents who sued after their son was born with brain damage and cerebral palsy accepted an $11.5 million settlement with Northwestern Memorial Hospital and the doctor involved with the birth. The family was represented by David R. Barry, Jr. During delivery, fetal monitor tracings indicated the baby was not tolerating labor and instead of working quickly to deliver the infant, the doctor allowed the mother to continue to push, thinking that with one or two more pushes, the baby would be delivered. Unfortunately, the baby was not delivered until the fifteenth push, some thirty-one minutes later.
