Family of two brothers injured by car driven into crowd files lawsuit

Garrett Flavin, father of 17 year-old Garrett Flavin, Jr., and 14 year-old Steven Flavin, who were both injured when hit by a car driven into a crowd of people near Durkin Park, filed a lawsuit today in the Circuit Court of Cook County, said his attorney Robert J. Bingle, of the law firm of Corboy & Demetrio.

On the evening of July 14, 2007, a young man was seriously beaten near Durkin Park. Shortly afterward a large crowd of neighbors and residents gathered near the park, which included Garrett Flavin and his brother Steven. As they stood in this group of people, Devoya Jackson got into the driver’s seat of his sister’s car and drove the car into the crowd, injuring Garrett and Steven and several other people.

In addition to filing a lawsuit, Bingle also sought a Protective Order to preserve and protect the original tape recordings of any 911 emergency system calls and any and all reports prepared by the Chicago Police Department, the Chicago Fire Department or the Office of Emergency Management.

Attorney Bingle said:

Preliminary reports suggest that numerous calls were made to 911 when the disturbance in the park first started and continued to be made throughout the entire incident. The dispatchers didn’t send a police car for 20 or 25 minutes after all these frantic calls were made. On behalf of these injured young men, we are going to investigate this delay.
