Lawsuit Filed in Chicago Porch Collapse; Protective Order Issued

May 2009

Chicago personal injury lawyer Francis Patrick Murphy, a partner at the law firm of Corboy & Demetrio, filed a lawsuit against the owners of a University Village apartment building in Chicago after two young adults were seriously injured when the second floor porch railing they were leaning against collapsed and they fell to the ground. He also filed an emergency motion for a Protective Order seeking to protect the rights and interests of his clients.

Porch Railing Collapse Lawsuit

The complaint alleges that on May 24, 2009, a young man and woman were leaning against an outside porch railing at an apartment building at 1005 South Racine Avenue in Chicago, Illinois. Without warning, the railing broke away and they fell to the ground, sustaining serious injuries.

At the same time he filed the complaint, Murphy filed an emergency motion requesting that the owners preserve the porch and railing in its current condition and that a safety expert be allowed to view, photograph and examine the site. The motion was granted and a Protective Order was issued by Judge Ronald Davis of the Circuit Court of Cook County, Law Division.

Murphy stated:

Early summer is a time when many tenants and home owners start using their decks and porches. It is imperative that each and every deck and porch be inspected and examined each year to make sure they are structurally sound so that incidents like this don’t happen.

The emergency motion was filed because it is imperative that we secure the evidence and allow experts to inspect the site. Our clients’ interests must be protected.
