$3.75 Million Settlement for Motorcyclist Injured in Crash
September 18, 2008On September 17 2008, David Rodriquez, who was injured when a car crashed into his motorcycle, and his wife, Laurie Rodriquez settled their lawsuit against John Voss and Eagle Ridge Corporation for $3.75 million. Attorney Philip Harnett Corboy, Jr., of the Chicago personal injury law firm Corboy & Demetrio, represented the couple.
Motorcycle Injury Lawsuit
On Tuesday, May 17, 2005, at approximately 6 p.m., David Rodriquez, a 46 year-old union carpenter foreman, was driving home from a video store on his Harley Davidson motorcycle along Route 30 in New Lenox, Illinois. As Rodriquez drove westbound, closely behind a large SUV, John Voss, an 18 year-old laborer for Eagle Ridge Construction Company, pulled his pickup truck out from a stop sign at Marley Road and Route 30 and struck Rodriquez’s motorcycle. Voss claimed that his view of Rodriquez was obstructed by the SUV and he did not see him until he pulled out into the intersection.
Voss was employed at the Eagle Ridge Construction Company work site at Route 30 and Marley Road on May 17 and had left work at 5 p.m. He went back to the site for his uncle, who was also his supervisor at the Company, to retrieve a measuring tape for a project his uncle was working on at home. The crash occurred when Voss was bringing the tape to his uncle.
Rodriquez was taken to St. James Hospital in Olympia Fields and was subsequently transferred to Advocate Lutheran General Hospital. Doctors determined that the tissue damage and fractures to his right lower leg were so severe that they ultimately performed a below the knee amputation. In addition, Rodriguez suffered hip and pelvis fractures.
