Emergency Petition Filed in Chinatown CTA Station Truck Collision Case

On April 28, 2008, attorney Michael K. Demetrio, partner at the law firm of Corboy & Demetrio, filed an Emergency Petition in the Circuit Court of Cook County, Chancery Division, on behalf of Nicole Latimore, who was seriously injured at the Chinatown Chicago Transit Authority (CTA) station when a White Line Express, Ltd. semi tractor-trailer truck, driven by Don Wells, plowed into the station on Friday, April 25, 2008. The Petition seeks to secure, preserve and protect evidence involved in the collision.

Demetrio filed the Emergency Petition under Illinois Supreme Court Rule 214, stating that Whiteline Express, Ltd. owned the semi tractor-trailer truck driven by its employee and/or agent Don Wells, and has records and information regarding the operation and maintenance of the truck. It further stated that the Chicago Police Department and the CTA have videos, photographs and test results regarding this collision. To properly investigate and protect Latimore’’s rights, the Petition seeks to preserve and protect any and all investigative records and materials.

Demetrio asks the Court to order Whiteline and Wells to preserve, protect any and all records in their possession pertaining to the truck and the collision and to order the Chicago Police Department and the CTA to preserve, protect any and all records, videos and other materials in their possession pertaining to the collision and investigation.

Demetrio stated:

It is imperative that we secure any and all records and information pertaining to this horrific collision in order to properly protect the legal rights and interests of Ms. Latimore and the other victims. Fortunately the laws of this jurisdiction and our Courts provide a reliable system to secure such protection.
